Of course the reporter hedges their article by repeating "far-right militia" and "far-right extremist", at at the core here is that the prosecutors are lying about the evidence and the judge isn't buying it (or not all of it anyway).

BS. If they were doing their job correctly they would be working from the evidence, not make it up so the headlines will taint the public opinion and then 'clarify' it later.
"After she was pressed by a judge in a recent hearing, Rakoczy conceded authorities "do not have at this point someone explicitly saying, 'our plan is to force entry into the Capitol in order to stop the certification,'" but cautioned that the investigation is ongoing."
which tells me they haven't been able to make up enough evidence. Yet.
If these guys really are innocent I wish them the best defense money can buy, along with a counter-suit for subjecting them to a witch hunt. And if the AP is starting to notice the problems with their cases it's not looking good for the prosecution.
