They had to send pictures of it in it's current configuration, so, if they put a stock on it later, it would violate the NFA without a stamp and now they'll be on the hook for an "unregistered" SBR. Pretty sure that's how it went. I didn't touch a thing on any of mine, so, good luck to those that did. I remember some guys selling their pistols because they didn't want the hassle, big pussies.

Saw a number of posts (not here because “it’s bad”) and even a lawyer YouTube about this. All they required was a picture of the receiver: no “illegal” pistol brace. Once it was Approved you install regular stock. Seemed remarkably easy. Didn’t even require engraving. If you wanted an SBR it certainly was the cheap way to go. Unless they start sending out Cancellation Notices, or something, I don’t see how these are still not a registered SBR.
 
I did 4 e-form 1s for SBRs. The only difference was it was free and the form went away after the expiration date. I read everything I could find on the freebie and found no difference on the form and didn't need any pictures, so I planned for it, and transferred 4 lowers into my trust, with a transfer of property document, dated and notarized prior to 12/31 then sent the form 1s in, in the trust name with proof of transfer. I think it Phucked with ATF's brains because they're still sitting there awaiting approval, and per their crap rule the application makes them legal as SBRs.

I will chalk it up to 4 free SBRs in my trust or ATF will just dump them if they lose in court. That doesn't bother me, since I'm already on several of their "lists" for NFA and other reasons.
 
No full pictures of the firearm were required, just of the SN and manufacture markings. I have prior SBRs and just chocked it up as a way to easily get some more SBRs which I was already planing to do. This was an SBR registration as box 4b states (Type of firearm to be made "SHORT BARRELED RIFLE") The previously SBR F1 process required engraving and I found that the most obnoxious part of the process. The brace SBR registration allowed you to adopt the manufacture markings and did not require engraving. Once the firearm was registered as an SBR a regular stock can be added in place of the goofy pistol brace stock.

For the moment, it makes little difference. Their "new rule" states an application makes it legal with no deference to brace or stock just SBR.

We have to wait and see what they do or what the courts order. Will they honor the freebie on the registered lowers or?????

I can easily see a vindictive ATF putting out an "opinion letter" that the "registered" pistol brace exceptions are no longer valid SBR's, and must be immediately be disassembled or destroyed.

I find it odd that people are willing to shell out $200+ for a "brace", when it's more than the cost of a Form 1 stamp. Especially now...my SBS eForm 1 was approved in 6 days (trust, not personal).

Yea, you think they're gonna honor those SBRs? :naughty: They're gonna come back with a vengeance once the dust settles, trying to make examples out of folks. They'll try to get their "pound of flesh" one way or another.

A vengeance opinion from ATF puts them afoul of one of their other longstanding interpretations and the case they lost to Thompson. A receiver like an AR or TC, which was first constructed as a pistol can later become a rifle and legally revert back to a pistol. For this reason, I've assembled several lowers with short barrels, and a pistol buffer, took a picture that clearly shows the serial number, and now they can be anything they want. I can choose their pronoun.

The 4 that I registered we bought as "pistols", with braces, ATF told me to register them as rifles for free, OK, I did. My 4 items can easily remain as pistols with arm braces, or they can be SBRs with braces or maybe a nice stock.

For me, I see no downside. It's only a bit more work if they revert back to pistols, I will likely distribute them from the trust back to personal ownership.
 
I guess I'm one of those suckers who registered their braced pistols that I was going to sbr anyway. My intent was to sbr them long before this "rule" became effective.

Did not have to send pics of entire gun, just pic of receiver markings.

Did not have to engrave my firearms.

Did not have to pay $200.

I'm already on their list with Form 4s for suppressors
