Attached are two proposals for the final order to be considered by Judge Cohen. The proposal drafted by the Brewer law firm is crap and will be ignored, because it does not address the objectives identified by Judge Cohen during the trial. The proposal from the NYAG is succinct, to the point, equitable and certainly palatable. The NYAG proposal is drafted in the best interests of all NRA members without malice. Ironically, the NYAG, after being characterized as the boogeyman, has been working diligently for NRA members while the NRA Attorneys are fleecing the NRA.
The New York Attorney General Charities Division has just handed a huge “super bowl” win for the NRA members and are working to protect the public from people like Wayne LaPierre and his ilk? Best of all, the NYAG is tasked with collecting from Wayne and Woody Phillips our members’ monies plus 9% interest from February and delivering to the NRA within 45 days. The order that truly benefits the NRA looks similar to the letter that was drafted by myself and Rocky and sent to the judge August 14, 2024.
Of the 10 items we requested in our proposal, the NYAG supported 5 of these items and added additional detail. Overall, this is a huge victory and a good deal. If the Judge chooses to sign the NYAG order, the NRA 2.0 is off to a great start with monumental changes our members deserve. The NRA attorneys should have and could have negotiated a settlement to this case in the summer of 2022 and saved the members $150MM. Wonder why that never happened?
