It would tough to say that a normal person would have to "weigh out" their actions when a mob has descended on your car. I couldn't imagine sitting there and thinking, "well, they haven't broken my window so I guess I'll just sit here while they climb, kick, and damage my vehicle.
 
Such is where it matters a great deal how you APPEAR to a jury. Do you outwardly APPEAR disabled and disadvantaged and frail? In my case, yes. After my truck accident 3 years ago and long hospitalization and recovery, I am legitimately disabled and walk with a cane. It is rather obvious to the casual observer that there's no way I could go hands on with anybody and have even half a chance of surviving a beatdown. Therefore, I present a sympathetic victim. I can't run. I can't (effectively) fight (with nothing but open hands). Even a jury that might be otherwise hostile is likely to look at my circumstances and say, "Well, what else could he do? Of course he shot the bastards."
