It’s funny when sheep like you accuse others of being drones simply because they want to see the supposed facts and evidence for themselves, but at the same time you haven’t stopped swinging from the nutsacks of Trump, Alex Jones, and the like for years now. I would have thought that after Trump took $250 million in donations for “eLeCTiOn FrAUd” and then did nothing but pay off his cronies you would have wised up to the reality of what the claims are all about, but apparently you’re a slow learner.

I’m not any happier about the results of the election than you are and I’m not going to attempt to defend the incompetence of anyone in government, but there are very legitimate reasons why Lake lost… namely her attachment to a proven loser (Trump) and her detachment from the reality of the issues voters are facing on a daily basis.

We had an astronomical increase in housing costs during Covid. Prices for everyday essentials like gas and groceries have been rising faster in AZ than anywhere else in the country. The border is a disaster. Crime is through the roof. And here we have people that can’t think of any reason besides “election fraud” that a majority of people didn’t want to put a news anchor who has zero business experience, zero political experience, and ranted about a bunch of irrelevant s*** instead of focusing on core issues at the helm of a multi-billion dollar operation serving 7.5 million people.

It’s going to so great when the imbeciles running Cochise county to have their votes invalidated, which will flip a house seat back to the dems, flip the schools back to the dems, and ruin any chance of a recount victory for AG. But hey, keep pushing the election fraud claims without a shred of evidence. It’s working out so well for everyone.

Did Katie Hobbs Have A Conflict of Interest?
As you know, Katie Hobbs has been declared the winner in Arizona’s governors race over Kari Lake. It was a close election, with Kari “losing” by a mere .06%.

Questions have been raised for a long time whether Hobbs, as Secretary of State, should have supervised an election in which she was the candidate. This appears to be a classic conflict of interest. But Hobbs ignored this and insisted that she be in charge of her own race. In my view, Kate Hobbs had, and continues to have, a clear conflict of interest under Arizona law. She was a candidate in an election that she is ultimately responsible for, from enforcing the Election Procedure Manual, to certification of the canvass, to testing the logic and accuracy and the functioning of the tabulation machines.

No candidate can supervise their own election. Indeed, no candidate can so much as even work at an election poll or counting center (nor can their immediate family members), according to ARS 16-531(A), (D); Arizona Election Procedure Manual pp. 132-139.

Under the conflict-of-interest law: A.R.S. §38-503(A). “Any public employee who has, or whose relative has, a substantial interest in any decision of a public agency shall disclose such interest and refrain from participating in any manner in such decision.”

There are two requirements for recusal. (1) Does the public official have a personal interest in the outcome of the action or decision at issue and (2) is there a financial interest that can be identified? In this case, Hobbs, as the candidate for governor, has a personal interest that differed from the general public. Prong one is satisfied. In addition, the job of governor has a salary of $90,000 plus benefits. This qualifies as a financial benefit or incentive not shared with the general public. Accordingly, Hobbs meets the requirements for recusal and in my view violated the law.

The remedy for a violation of this law: the decision or action taken in which Hobbs participated is “undone” and the process is repeated without her participation. As set forth in the law: “ARS 8.16.4 Private Citizen Suits. Any person who is affected by a public agency's decision made in violation of the conflict-of-interest laws may sue to have the contract or decision declared null and void. A.R.S. § 38-506(B). The court may award costs and attorney's fees to the prevailing party. A.R.S. § 38-506(C). Persons claiming that a public officer, employee, or board member had a pecuniary interest in making a decision against them may also file suit in state or federal court alleging a violation of their civil rights pursuant to 42 U.S.C. § 1983.”

Violation of this law is also a Class 6 felony, according to ARS § 38-510(A)(1).

The Attorney General has stated: “Negligent or reckless violation of the law is a class 1 misdemeanor. This means that public officers or employees may be prosecuted if they fail to disclose a conflict of interest of which they should have known. A.R.S. § 38-510(A)(2).”

Lastly, a public officer found in violation of this law is to be removed from office. Actions taken, for example, a contract signed, are to be voided. In this case, the election could be voided and redone without the conflict.

It has been factually established that upwards of 50% of the voting centers in Maricopa County failed because of disabled printers. This led to lines as long as two to three hours wait time. Many people gave up and never voted that day. It is indeed possible that over 17,000 people were disenfranchised and left the polling centers because they did not have two to three hours to wait that day. That would have been enough to cost Kari Lake the election. There are pending lawsuits. We will have to wait and see if anything comes of this, but based on prior court challenges, I would not hold my breath for court relief.
