Are Bump Stocks Still Alive? Feds Drop Charges Because They Couldn’t Prove Devices are Machine Guns

A bump stock case in Houston is making waves in the pro-gun community after federal prosecutors dropped bump stock-related charges against a man because “the government couldn’t prove beyond a reasonable doubt the bump stock was a machine gun,” according to the Houston Chronicle.

Ajay Dhingra, 44, was convicted for lying when he purchased a handgun, rifle and ammunition, and illegally possessing a weapon as a person who had been committed for mental illness. But federal prosecutors dropped charges for bump stock possession after Dhingra’s defense found a former ATF agent willing to testify that bump stocks are not machine guns.

That agent, Rick Vasquez, was ready to testify that, unlike machine guns, bump stocks require the shooter to make contact with the trigger each time a round is fired. His testimony convinced the prosecution that they would be unable to prove that a bump stock is a machine gun, despite the ATF ruling in 2018 that the two are synonymous.

“If something doesn’t meet the definition of a machine gun, it’s not a machine gun,” said defense attorney Tom Berg. “And no amount of wishing or passing rules can change it.”
 
They dropped the charge cause he was phucked on 4 or 5 other club fed reservations. They didnt need to walk that limb just yet.

But just like when they dropped the AR receiver possetion prosecution in a couple places, they will have trouble proving that magic words making a machineguns out of a loose hold or a piece of plastic and spring suddenly changing almost a 100 years of codified definition.

That said They will find a judge, eventually, who will ignore reality and expert testimony and rig the trial as much as possible. Or get a law change.

They are still technically banned via ATF fiat, but they are smart enough to know that no court outside of NY or CA is going to blow it over like a house of cards.
 
I don't want to be the test case that is successful!
Remember, if it goes to a circuit court on appeal from this state it's the 9th in S.F.
 
The 6th circuit court has already ruled against the ATF’s new definition of a bump-stock as a machinegun, (Bump Stocks Are Not Machine Guns, Sixth Circuit Rules – Courthouse News Service 3/25/2021).

The problem is, if they bring charges here in AZ and get the liberal 9th Circus to rule in their favor, it will have to get rammed up their SCOTUS.

Unless you have backing with deep pockets, I don’t think you want to be that test case either and results are very unpredictable.

I had to jump into this. I'm 60, and I own a lot of fudd guns. Revolvers, 1911s, like that. But I also own 20 round polymer pistols and AR15s, some of which have been created with the assistance of a Makita router. And lots of other fun stuff I don't want to mention on a public forum.

I have absolutely NO use for bump stocks, but I vehemently disagree with the current law banning them.

Like a wise man once said (something like) "I said nothing when they banned bump stocks, because I didn't own one"

Yeah, then they ban something else, and you keep your mouth shut because you don't own one, then one day they come for your fudd guns, and guess what, now its too damn late.

Yeah, I don't follow trends, so I really didn't know someone had come up with another doo dad to convert an AR to full auto. Full auto aint my thing. If they were the same price as regular guns I
might have one. Its just no big deal for me.

I guess for the guys who got to have to get more little gold stars on their man cards maybe it is big deal. There are guys who get dirty and do dangerous stuff at work and at play. These guys know guns are tools

Apparently we are talking about two different things here.
I was thinking of broken or un-shootable guns that are no good for anything but hanging on walls to look at. I just figured everyone had heard of them.

You were apparently talking about some plastic thing someone made that supposedly can be used as a hook to hang things with or used to convert an AR to full auto.

To tell the truth I just found out about that " wall hanger " also and didn't know anything about it until someone recently posted about it.

I didn't read every post in this thread and missed that part.
