With a home based FFL, what happens to deliveries when the person is not home?

If a firearm is shipped to the home (home based FFL), but no one is there, do they do the whole "try again tomorrow" sticky note thing? Can an FFL arrange to pick it up themselves at UPS?

They can sell remaining inventory to another dealer, or it can be transferred to them personally.

Got it. Along the same lines, in the case of the FFL having an SOT, what would happen with SBRs, suppressors, etc if the FFL is setup as an LLC vs a sole proprietorship?
 
If they are an LLC, NFA items that could be on a form 4 can be kept as long as the LLC isn’t desolved, or can be submitted on form 4s.
Post 86 samples either have to be demilled or turned in to the ATF, in my case I’ll turn my MP5s into parts kits.

Not sure about sole proprietorship.

The LLC can be sold or have members changed after filing and getting approval from the corporate commotion.
As to the firearms, again with approval from the ATF the firearms can be transferred with the LLC.

These are based off of conversations I’ve had with the ATF, as always, to be sure contact them for a definitive answer, I’m no lawyer, and really their positions on things change so often that what was true yesterday may not be today.

Do you know if the ATF approval is a simple thing or if it requires a full form 4 sort of thing? I hear what you are saying...it's unfortunate that their is so much subjectivity in these laws.
 
Should be simple, if you’re just adding members to the LLC there’s no need to even involve the ATF.
If it’s a complete change of hands you’d have to refile the FFL since it would be under new management/responsible parties.

As I said though, just call your local ATF field office for guidance, as much as people give them hell (rightly so in many cases) the local guys have always been helpful when I’ve had questions.
