It will be up to each state. Wait, did SCOTUS just return a little bit of power to the states?
 
First of all... The person that leaked this draft, should they be found (I believe they will be), can consider their legal career over. This is unprecedented & will not be tolerated...

Secondly... Keep in mind that this is just a draft that has been leaked. It could be months before the decision could come down. The Justices could change their minds/mind...

Thirdly... This is the swamp, anything could happen...
 
The crux of the argument for overturning Roe, ""The Constitution makes no reference to abortion and no such right is implicitly protected by any constitutional provision". This is going to be a very slippery slope for future cases. The Constitution doesn't make reference or implicit reference to the Internet, television, AR-15's, etc.

I'm still waiting for someone to introduce a law making a vasectomy illegal.

Yep!! Many of us have been watching this closely for that reason. If this leaked document is the actual decision, this is a states rights issue. This could have some interesting ramifications on a number of issues.

The Constitution does make implicit reference to the Internet, television, AR-15's, etc; the 1st and 2nd Amendments. "Implicit", meaning implied, though not plainly expressed or essentially or very closely connected with.

That's a non sequitur. If you want to scoop out your organs or snip them. You're free to do so, just like if you want to cover your body in tattoos. All people (inside the womb or out) have a right to life, liberty, and the pursuit of happiness.

Dude, I had to look that word up. I'm not familiar with what you're talking about, but I'd love to see you expound upon that subject.

Honestly, I don't care if a woman has an abortion and murders her child, that's up to her. I do have a problem with these folks calling it a "Constitutional Right" when it's clearly evident it isn't,and never was. SCOTUS sets a precedent, nothing more, the opinions of judges change over time, but it's not "law" in any sense. This was one of those precedents, the court has opined that the "right" doesn't exist in the Constitution, and therefore leaves the power to the States, EG. 9th and 10th Amendments.

On the bright side, maybe it'll cause all these whackjobs from other states to go home where they came from. There's a law on the book from 1901 that bans abortion period, and gives jail time to those assisting.

Now, let's get them to overturn Wickard V. Filburn, and remove all that power the Feds have stolen illegally.
