Kansas is within the 10th Circuit, which is nearly as bad as the Ninth on gun cases. The judge knew this is going to definitely be appealed and overturned in the 10th Circuit, and appears to be consciously generating a case to be groomed for getting heard at the SCOTUS.

I don’t see the logic in that when he simply could have allowed the charge to stand, placing the onus of appeal on the defendant.

No, I’m very happy with the ruling. My point was if the judge wanted a ruling that denied the defendant’s second amendment right to possess a machine gun he could have done that himself. I am hoping that this is the beginning of a movement in the federal courts to loosen, and eventually remove, NFA regulations across the board.
