When people say the 2A is for people to defend themselves against a tyrannical government, this is what they mean.

One person making a unilateral decision to abolish parts of the Constitution.

I'll bet its legality is challenged very quickly.

Daughter and son-in-law went to the NM State Fair in ABQ yesterday. For as long as I can remember the NMSP has worked the entrances and asked everyone carrying firearms to let them know on their way in. Not the point of this post, but…

Both daughter and SIL were carrying. Both informed NMSP. Both were waived in without delay. Apparently no one at NMSP is very concerned about the gubnor’s new rule.

Too bad New Mexico doesn’t have a harbor with a shipload of tea to mess around with! Maybe a bunch of NM patriots could burn an 18 wheeler load of Poblano peppers at the state capitol instead?

More from DbD....

Blackwing1

US Code 18 Section 241 states:

“If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same; or
If two or more persons go in disguise on the highway, or on the premises of another, with intent to prevent or hinder his free exercise or enjoyment of any right or privilege so secured—
They shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, they shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death.”

If we had a federal government that was actually interested in its job (protecting the rights of its citizens) the governor, along with anyone on her staff that assisted in drafting or promulgating this blatantly unconstitutional executive order, would be rounded up, imprisoned, tried, and convicted under this code. If anyone were to be arrested and jailed under this ukase this could then be considered kidnapping, and the death penalty would be on the table.

If anyone here on this site honestly believes that our current SwampState will do literally ANYTHING about this, I’ve got a large bridge for sale in Brooklyn; cash only, small non-consecutive bills, please.

So the question for Allen, Medina, and other law enforcement officials might be this: "Why not arrest Governor Lujan Grisham?" That's what stalwart Second Amendment advocate Charles C.W. Cooke wants to know, albeit with tongue-in-cheek.

Lujan Grisham simply wanted to declare this suspension, despite having no legal justification for doing so. To emphasize that point, Cooke "facetiously" argues:

So arrest her — without a warrant and without cause. Put her in prison for 30 days without a trial. Raise her taxes to 100 percent without an appropriations bill. Take her property without reimbursement. Quarter some troops in her home. Impose an excessive fine. Hit her with a bill of attainder — imposed ex post facto if possible. And, for good measure, prevent her from complaining about it by imposing a monthlong gag order — to be lifted once this emergency has gone.

Would that be wrong? Here's a challenge: Explain why it would be wrong without appealing to the rule of law.

It's a brilliant thought exercise, though it's not unlike real-world examples. Governors Greg Abbott and Ron DeSantis have both sent many busloads of illegal aliens to sanctuary jurisdictions to prove and highlight the gross hypocrisy of the open-borders crowd. It's working.
