ST. LOUIS – Mark and Patricia McCloskey, the Central West End couple who plead not guilty to charges for pointing guns at protesters back in June may soon face another legal issue.

According to our partners at the Post- Dispatch, United Press International is considering whether to send a “cease and desist” order to the couple because they’re using this UPI photo as part of their personal greeting card.

UPI’s director of photography in Washington says the photo was being used without permission and the company’s legal department is looking into it.

Umm, I'm not a lawyer (but both the McCloskeys are!). But wouldn't a lawsuit on use really only have any teeth if they were profiting from use of the image?

Everyone sues everyone for the dumbest s*** these days. What's next, someone takes a picture of a cool car on the street, posted it to Facebook captioned "Check out this cool car", get sued by the owner for taking a picture of a cool car in public.

I think the cards are awesome but I will admit ... In this climate and with a very politically motivated prosecutor not averse to evidence tampering I wouldn't poke the bear!

That was my first thought, they're not selling it...that we know of.
