You know, there might be a silver lining to this. If they are classified as non firearms, then maybe ATF under new management just might decide to remove them from regs. Just a thought. Maybe this is some elaborate scheme to put them in a non firearms category.

As he calls out in the video, it's pretty clear in the 1934 NFA that a "silencer" is considered a gun in the text of the law. Any law or ruling otherwise is conflicting, which would trigger an appeal of the ruling or an eventual challenge to the original law. As much as I would love to see suppressors removed from the NFA (and maybe a tax refund for all of my stamps), I don't think that's an easy path to rule away a 91 year old law. I'd rather see a legislative solution.
But of course it's always a double-edged sword. If suppressors are just "accessories", they would be significantly more accessible and cheaper, but would also lose some level of protections that a future administration could take advantage of to enact nation-wide restrictions instead of just state-by-state.
