It would appear that, at this moment, in the 9th Circuit, non-violent felons have gun rights.
I'm not an attorney, so maybe I'm missing something. But my understanding is that when a Circuit appeals court renders ruling on Constitutional rights, that sets precedent across that Circuit until and unless either an en banc panel of all the Circuit's appellate judges or the Supreme Court overturns it.

Well, the DOJ is clutching their pearls over this and immediately filed petition with the 9th Circuit to re-hear the case "en banc", which means instead of the 3 judges who heard and ruled on this, the entire 9th Circuit panel of judges would hear it.
No word yet on whether the 9th will agree to that, but I have every expectation that they will.
