Let me guess, the 9th will not follow their own rules and take this one directly to en banc like the did with the magazine ban.

I predict the 9th Circuit's strategy will be to delay, delay, delay as long as possible, in the hope that the Supreme Court can be neutralized somehow, by the death of, say, Clarence Thomas, to be replaced by a Biden appointee, or by packing the Court, or something. Maybe they will remand for reconsideration, or some other stalling tactic. Don’t expect the 9th Circuit ruling any time soon.
