UPDATE:

Rare Breed has been of the (factual) opinion that their product is actually in compliance with the law and is not a machinegun, so they have continued to not only fight the ATF, but has been very public in their descriptions of how, why, what, when and absolutely everything regarding their case, their product and their position,...playing their case out in front of the public as it occurs. The government wants them stopped from making their rational arguments and explanations public.

Oh yeah,...and figuring if they're in for an ounce, they're in for a pound, Rare Breed has continued to sell the FRT since no court decision has yet been rendered deciding whether the FRT is an MG.

So ATF went and got a TRO on Rare Breed.

As set forth in the January 25, 2023 temporary restraining order (“TRO”), among other things, the Court found that “[t]here is probable cause to believe that Defendants’ fraudulent conduct is ongoing and imminent,” that “Defendants failed to register FRT-15s for the purpose of concealing from ATF the sale and transfer of these items,” and that the TRO is necessary to prevent “a continuing and substantial injury to the United States, as well as to past and future purchasers of FRT-15s who have been or may be misled into believing that their possession of FRT-15s is lawful when it is not.”

So of course, if the 2nd Amendment doesn't mean schit, neither does the 1st.
