I have a AR-9 with a 8.5 inch barrel and brace. Due to the up coming rule changes I dont want to mess with NFA paper work. Is it legal to just replace the barrel with a 16 inch barrel and put a stock on it?

Did you buy it as a pistol, rifle, or "firearm".

A pistol can be made to a rifle. A rifle cannot be converted to a pistol/SBR.

I would also wait and don’t be concerned with threats. It hasn’t happened

Like Clyde asked it depends on what’s the lower was registered as

Bought as a pistol. I would like to at least buy the barrel to have on hand in case their un-lawful rule becomes law.

For years the ATF standard for minimum length of a standard rifle (and by “standard rifle” I mean rifles that aren’t C&R NFA exempt) is 26 inches (although a lotta folks add on another .5” just to be safe). So, in order to achieve that you may have to put a barrel longer than 16” on. Oh, (and I’m not implying that you don’t know this) and understand how the length of a barrel is measured when installed on a rifle.

Thank you for the information. I have learned that taking off the brace is also an option.

You can change the barrel for a 16"

Or have a fake suppressor pinned and welded on to bring it up to rifle length.

Or, remove the brace.

While the ATF may allow mere removal of the brace or addition of a longer barrel to equal compliance now,...there is no reason to trust it won't alter things once again. At some future point, ATF may decide that possessing both an unmounted brace and pistol to be "constructive possession" of an SBR, just as they do with components of machineguns and suppressors. It fact, is it out of their nature to not do so.

I am NOT advocating compliance. But never forget their evil nature. Never expect reasonable.
